1. Technology platform

Kembali2U provides software for customer retention, rewards, referrals, reminders, campaigns and Lucky Draws. Participating merchants are independent businesses. Kembali2U is not the merchant’s agent, franchisee, employer, partner, prize sponsor or reward fulfiller.

2. Merchant offers and fulfilment

Each merchant independently creates, describes, funds, operates and fulfils its own rewards, vouchers, discounts, promotions, prizes and Lucky Draws. The merchant is responsible for eligibility, availability, legality, quality and fulfilment. Kembali2U does not hold merchant prize funds and does not guarantee a merchant offer. Fulfilment disputes should be raised with the issuing merchant. Kembali2U may investigate platform misuse and preserve records but does not assume the merchant’s commercial obligation.

3. Campaign integrity

Merchants must publish accurate terms and be able to honour them. After activation, material terms that could disadvantage participating customers—including the prize, core eligibility rules and campaign period—must not be silently changed. Cancellation or permitted corrections must remain auditable.

4. Prohibited use

No fake or misleading prizes, unlawful offers, fabricated customers, manipulated visits/referrals, interference with random draws, unauthorized access, security abuse or unlawful use of customer information. Kembali2U may suspend campaigns or accounts where credible misuse or legal risk is detected.

5. Applications, subscriptions and payments

Merchant and Agent applications do not by themselves create paid status, entitlement, commission or referral rewards. Verification, activation and payment rules shown by the platform remain authoritative.

6. Merchant responsibility and indemnity

To the extent permitted by applicable law, a merchant is responsible for claims, losses or costs caused by its own products, services, statements, offers, unlawful conduct or failure to fulfil a promise, and agrees to indemnify Kembali2U and its operator against third-party claims arising from those matters.

7. Platform responsibility

Kembali2U remains responsible for its own platform functions, billing processes and handling of personal data as required by applicable law. Nothing excludes rights or liabilities that cannot lawfully be excluded.
